SAN DIEGO (CBS 8) - An illegal immigrant living in Florida who returned to Mexico for a family emergency was denied entry back into the U.S. in San Ysidro on Tuesday.
Rafael Gaytan and his wife came to the U.S.illegally about 10-years-ago. Their two children were born here.
He returned to Mexico 3-months-ago to care for his terminally ill sister. Gaytan is eligible for temporary immigration status under President Obama's Deferred Action for Parents of Americans program.
However, implementation of the program has been tied up in the courts.
Gaytan's supporters say it's not clear if or when he will try to cross the border.
