SAN DIEGO (CBS 8) - A man accused of being high behind the wheel and causing a deadly crash faces a judge Wednesday.
Joel Silva will appear for arraignment on charges of DUI and gross vehicular manslaughter.
The California Highway Patrol says he hit and killed Kimberly Eakin Sunday in Lakeside.
Silva claims he fell asleep at the wheel.
Investigators say it's a possibility Silva was under the influence of medication, after finding several prescription drug bottles in his SUV.
