SAN DIEGO (CBS 8) - For the first time, we are seeing surveillance video of a Border Patrol agent accused of kicking and choking a Mexican national while in custody.

Last month, border agent Luis Fonseca walked out of federal court a free man after a jury found him not guilty of using extensive force.

A video shows Agent Fonseca approach the man after he did not follow orders to keep his hands on the wall. The agent then kicks him and allegedly chokes him until the man falls to the ground.

The man, Adolfo Ceja-Escobar, had been deported multiple times.

Jurors acquitted Fonseca in part because they believed Ceja-Escobar was faking his injuries.
