VISTA, Calif. — A Diegueño Middle School campus supervisor has pled not guilty to sexually assaulting a student under 14 years old and providing another minor with marijuana.
21-year-old Omar Hernandez Galeana had been working at the school as a campus supervisor for three months when deputies arrested him. San Diego County Sheriff’s deputies say Galeana met up with two student victims over the weekend, outside of school hours and off campus where he had sex with one student and gave marijuana to another. Prosecutors tell CBS 8 the two victims were both 12 years old.
Nereida Bowman is the San Diego County Deputy District Attorney prosecuting Galeana’s case.
"The defendant would communicate with the minors via text message, specifically What's App," Bowman said after the arraignment. "As you heard in the arraignment he would tell those minors to delete the messages because there would be consequences for him."
Galeana is facing 12 charges including two counts of aggravated sexual assault of a child, four counts of forcible lewd act upon a child, three counts of furnishing cannabis to a minor under 14 and three counts of contributing to the delinquency of a minor.
"The alleged offenses occurred March 23rd and March 24th," Bowman said. "We believe that this defendant communicated with the defendants prior to that. He was someone that worked at their school. Someone they knew."
San Dieguito Union High School District sent out a letter to parents on Monday saying Galeana is no longer an employee.
Galeana's original bail was set at $235,000 but was changed to no bail because prosecutors say Galeana is a threat to the community.
"We argued for no bail given the seriousness of the charges, given my concerns that he might potentially flee now that he knows what charges he's facing and the potential consequences of those charges, as well as my concern for the remaining children at that school," Bowman said.
Galeana's attorneys didn't speak with CBS 8 on camera but in court advised he should be released on bail.
“Given the unsupported nature of the DA's claims that he's contacting the victims and asking them to erase text messages, we believe that can be protected with a criminal protective order," Galeana's attorney said.
Galeana's next court appearance is set for April 23. Investigators say if you know anything that can help, call law enforcement.
