Man accused of threatening to shoot up Shoal Creek Elementary will remain behind bars without bail for now

Bail hearing scheduled for Friday was canceled. Defense did not argue against no bail status.

POWAY, Calif. — A bail hearing scheduled for a man accused of threatening to commit a mass shooting at Shoal Creek Elementary was canceled on Friday morning after the defense chose not to argue against the prosecution's request to deny him a chance at bail.

38-year-old Lee Lor will remain behind bars without bail at least until his next court hearing, which is scheduled for December 13. 

Lor is charged with one count of making a criminal threat against Shoal Creek Elementary, which is located in the Poway-Unified School District. According to court paperwork, Lor targeted the school because "it is where the neighbor kids attend school."

Lor was arrested Friday at 2285 Rutherford Road in Carlsbad. The address is listed as the Quidel Corporation, a medical equipment manufacturer.  It's unclear what connection Lor has to that address. CBS 8 reached out to Quidel Friday morning and is waiting for a response back.

The home address Lor gave police is located about a mile from the school's campus.

According to court paperwork, Lor made the threat via e-mail. CBS 8 asked Deputy District Attorney Savanah Howe to clarify where Lor allegedly sent the e-mail.

"That e-mail, unfortunately, I can't talk about the specifics at this point at this hearing," said Howe. "The matter was taken off the calendar for the bail review. More information will be forthcoming at that next [court] date."

However, CBS 8 confirmed Friday morning with police that the e-mail threat was not sent directly to Shoal Creek. We were told by police there was some confusion early on with the investigation. Police confirmed it was sent to a third party, but would not disclose who the third party was.

Lor pleaded not guilty during his arraignment Tuesday. He faces a maximum of 3 years behind bars if convicted.
