Solana Beach says boo to KAABOO

City officials are suing the Del Mar Fairgrounds for failing to address impacts from one of San Diego's largest music festivals.

DEL MAR, Calif. — The city of Solana Beach is suing the Del Mar Fairgrounds for what it says is a lack of planning and environmental review for the KAABOO Music Fest coming to the Fairgrounds in September 2024.

In a non-conformed lawsuit obtained by CBS 8, outside attorneys for Solana Beach allege that Fairground staff approved the festival without looking at impacts from air pollution, greenhouse gas emissions from cars, noise, traffic, and the threats to public safety.

Reads the lawsuit, "The [Fairgrounds] failure to perform any environmental review of [KAABOO] leaves the city with no alternative but to seek the assistance of the court to compel the [Fairgrounds] to comply..."

The KAABOO fest is expected to draw tens of thousands of festival-goers each day over the four-day fest.

The September music festival will mark the return of KAABOO after taking five years off due to the pandemic as well as ensuing contractual issues between the festival promoters and PETCO Park where the festival was going to be held in 2020 and 2021.

Now, the new lawsuit from Solana Beach seeks to delay KAABOO yet another year.

The city is asking that a judge "vacate and set aside" the Fairgrounds' contract with KAABOO until an adequate environmental review is conducted. 

In a statement, a spokesperson for the Del Mar Fairgrounds told CBS 8 that the Fairgrounds staff has met with city officials in hopes of addressing their concerns. 

“We strive to be a good neighbor, and we have engaged in good-faith conversations about KAABOO with the City of Solana Beach for months. We have worked closely with the festival’s organizers to address the City’s concerns in the contract for this event," said the spokesperson.

The city of Solana Beach declined to comment for this story.
