Point Loma residents push back against tall project

Point Loma residents were furious Monday night over a new duplex project they are describing as a monstrosity, and which according to them will ruin the character of their neighborhood.

POINT LOMA (CBS 8) - Point Loma residents were furious Monday night over a new duplex project they are describing as a monstrosity, and which according to them will ruin the character of their neighborhood.

During Monday night's town hall meeting the foundation for a lawsuit against the developer, Pacific Enterprise Builders, was laid out.

Close to 300 residents are determined to stop the construction of the high-rise.

According to the city code, development projects in the area can only be 30-feet-high, but the new development along Emerson and Evergreen is 40-feet high.

Neighbors said the developer found a loophole and pushed in dirt to measure from above the would-be garage. The controversy is not being taken lightly after a protest on Saturday.

Peninsula Planning Board Chair Jon Linney also received a voicemail from an unknown number late Saturday night. "This message is for Jon Linney, you whiny b***h. The house is going up. Nothing you can f*****g do about it, you dip s***t. Get over it," said the unknown caller on the voicemail.

The developer could not be reached for comment.

CBS News 8 has also learned the architect behind the controversial project is also working on another development project down the street at Garrison and Locust, which has residents worried.

The community is currently working on setting up a bank account called "Keep San Diego Coastal Code 30-feet," which they said will help pay for an attorney to fight the current development project.

San Diego Mayor Kevin Faulconer and Councilmember Zapf released a joint statement which states:

"We are strong supporters of the coastal height limit and protecting coastal views. It is abundantly clear to us that this project does not conform to the spirit of the coastal height limit approved by voters under Proposition D. It is out of scope with the character of the community and we do not support it. We are working to explore every possible solution within the confines of the law to uphold the intent of the people. Going forward, we are also working on a long-term zoning solution to ensure all development in this multi-family residential zone adheres to the 30-foot height limit."
